General terms and conditions

These general terms and conditions for events and room reservations at the Winzerhotel Gumpoldskirchen KG, Wienerstraße 26, 2352 Gumpoldskirchen (hereinafter referred to as the "hotel") are part of the contract for the order placed by you (hereinafter referred to as the "guest"). The owner of the Winzerhotel Gumpoldskirchen is Mrs. Birgit Grill. Any other conditions of the guest are invalid. The "guest" submits to these conditions as well as all relevant commercial and other regulations and assumes liability for their compliance with his signature.

Cancellation of individual bookings/short-term bookings:
The provisions of the Austrian hotel regulations apply as follows.  

       – no cancellation fees apply up to 3 months before arrival

       – up to 1 month before the arrival date 40 % of the total arrangement price

       – up to 1 week before the arrival date 70 % of the total arrangement price

       – in the last week before the arrival date 90% of the total arrangement price

       – in case of no-show or early departure 100% of the total arrangement price

If we are able to resell the rooms, there will be no cancellation fees.

Cancellation of group bookings:
Rooms can be cancelled free of charge up to 7 weeks before arrival.
Up to 4 weeks before arrival, 50% of the agreed fee for all unsold rooms will be charged.
If cancelled within 4 weeks before arrival, 75% of all unsold rooms will be charged.
The number of rooms booked 1 week before arrival is binding and as such will be charged 100%.

Cancellation of events:
Free cancellation up to 7 weeks before the event.
After that, the room rental/accommodation will be charged in full. If the hotel is able to reassign the date at short notice, the room rental/accommodation will be credited. Number of participants: The number of participants is binding one week before arrival and will be invoiced. If more people attend the event than registered, the number actually present will be invoiced.

Service:
The hotel is happy to provide staff to guests after 9 p.m. In this case, each member of staff will be charged €40 per hour.

Music:
If the guest plans to play music during an event, we kindly request that he submit the necessary registrations to AKM in good time and in person. Local quiet hours must be observed!

Food and drinks brought in:
Bringing food and drinks to consume in public areas and facilities of the hotel is not permitted. Exceptions are possible with the express permission of the management.

Setting up seminar equipment/decorations:
The guest is obliged to inform the hotel of the intended installation of decorative material or other objects and to obtain their consent. The event rooms must not be damaged. Any damage will be charged.

Termination by the hotel:
The hotel is entitled to terminate the contractual relationship at any time and without giving reasons if
1) the reputation and security of the hotel are at risk
2) agreed deposits have not been made
3) the event hinders the smooth running of the hotel
4) the room is given to third parties without the knowledge of the hotel
5) force majeure prevails.
The guest is not entitled to claim damages.

Liability:
Reservations must be confirmed by authorized and signatory persons. These persons are jointly and severally liable for the fulfillment of all agreements with the hotel.
Items and valuables brought in: The hotel accepts no liability for loss or damage to items and valuables brought in. The organizer must arrange any special insurance themselves.
Valuables can be deposited in your own room safe free of charge.

Prices:
All prices are in Euro, including all taxes and duties; valid until revoked.

Pay:
cash payment & card payment

When paying by card, only Visa, Mastercard, EC & ATM card / debit card are accepted.

Deposits: After confirming a group reservation/event, we require a deposit of at least 30% of the expected turnover, but no later than 3 weeks before arrival, to our bank account:

Invoices are payable immediately without deduction. In the event of late payment, we are obliged to charge interest on arrears of 4% above the respective bank rate as well as additional reminder and collection fees.
Place of jurisdiction: Mödling is agreed as the place of jurisdiction

We have integrated components of the company seminargo GmbH, 1160 Vienna Liebhartsgasse 16 (“seminargo”) on our website. If you make an online booking or a booking request via our website, we need your first and last name, email address, company name and billing address to process it. The dates of your stay, the desired configuration and the number of participants are required to calculate the valid travel price. Your data for the online booking and the online booking request is processed on the basis of Art. 6 Paragraph 1 Letter b of GDPR and serves to fulfill a contract or to carry out pre-contractual measures. The data you send to us will remain with us until the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory legal provisions - in particular statutory retention periods - remain unaffected.
